1. Acceptance of Terms
By downloading, installing, or using ClimbingDad ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
2. Description of Service
ClimbingDad is a climbing training application that allows you to track climbing sessions, follow structured training paths, set goals, monitor progress, and receive rule-based training insights. The App is provided by Mateusz Kuba IT Consulting ("we", "our", "us").
3. Account Registration
To use the App, you must create an account with a valid email address and confirm it via email. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 13 years old to create an account.
4. Subscription & Payments
ClimbingDad offers a free tier with limited features and a Premium subscription for full access. Subscriptions are managed through the Apple App Store or Google Play Store and are subject to their respective terms.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Refunds are handled by the respective app store
- Deleting your account does not automatically cancel your subscription — you must cancel it in your app store settings
5. User Content
You retain ownership of the training data and content you create within the App. By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you.
6. Trainer Feature
The App allows you to optionally link with a professional climbing trainer via an invite code. If you do so:
- Your trainer can view your sessions and training path progress
- Your trainer can assign goals with coaching notes
- You can revoke the trainer link at any time from within the App
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App or its systems
- Reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's functionality
- Share your account credentials with others
8. Health & Safety Disclaimer
ClimbingDad is not a substitute for professional coaching or medical advice. Climbing is an inherently dangerous activity. You assume all risks associated with your climbing and training activities. We are not responsible for any injuries, damages, or losses resulting from your use of the training recommendations, readiness scores, regeneration insights, workout plans, or any other information provided by the App. Always consult a qualified professional before starting any training program.
9. Availability & Changes
We strive to keep the App available at all times but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. We will make reasonable efforts to notify you of significant changes.
10. Account Termination
You may delete your account at any time through the App (Profile → Delete account) or via our account deletion page. When you delete your account, all associated data is permanently removed. We may terminate or suspend your account if you violate these terms.
11. Intellectual Property
The App, including its design, code, content, training paths, and exercises, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.
12. Limitation of Liability
To the maximum extent permitted by law, ClimbingDad and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to physical injuries, data loss, or loss of profits.
13. Governing Law
These Terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of Poland.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use after changes constitutes acceptance.
